1. Application of general conditions
By placing an order at All Active Trading B.V. you automatically agree with the delivery and payment conditions of All Active Trading B.V.. All Active Trading B.V. has the right to change its delivery and payment conditions after the term has expired. The customer is bound by the general conditions according to Art. 6: 232 BW. All Active Trading B.V. relies on a justified trust that the customer has willingly bound himself by these general conditions.
2. Realization of an agreement
A purchase agreement comes about by supply and acceptance. The agreement comes about by placing an order, after which All Active Trading B.V. will send a receipt. An order is invalid when your address or place of residence cannot be determined unambiguously by All Active Trading B.V.. Possible inaccuracies in the receipt that you receive from All Active Trading B.V. must be reported to All Active Trading B.V. immediately, as well as possible changes or inaccuracies in the data which you have sent to All Active Trading B.V.. After delivery you have 30 days to check whether the ordered articles meet your demands and to inform All Active Trading B.V., or to return your order. If you have received articles that you didn’t order or if you have not received your articles, you have to contact All Active Trading B.V. as soon as possible. After that term the purchase comes about and you will become the owner.
3. Payment conditions
There are several methods of payment, if you decide to place an order on cyclewear.eu. All Active Trading B.V. only sends orders that have been paid for in advance, with the exception of C.O.D. orders. You can pay in advance, C.O.D., via Ideal and/or Paypal.Please, see “Frequently Asked Questions” for more details.
4. Offers and prices
All Active Trading B.V. always has the right to raise the prices of products. Prices are subject to change. Special offers are only valid during the stated terms. All Active Trading B.V. will not deviate from those terms. You cannot derive a right from that. Customers have to pay 21% VAT for their order.
5. Shipping costs
You pay shipping costs for each order. The shipping costs will be determined according to our schedule of shipping costs per country in the EU. There are no shipping costs for orders of more than 75 euros (* See shipping table), shipping costs excluded. For mailings outside the EU, you can contact All Active Trading B.V. for the shipping costs. You can find the schedule of shipping costs under “send & return”.
6. Shipment and delivery term
Articles are sent by PostNL. The general conditions of PostNL are applicable for the shipping of your parcel. (http://www.postnl.nl/voorthuis/site/disclaimer/) On receipt of the payment the ordered articles are delivered as soon as possible. The delivery term depends on when we receive your payment. If you receive a mail stating that your parcel has been sent, it will take 1 or 2 days (for the Netherlands, see schedule of delivery costs for the rest of EU) for the parcel to arrive. Owing to circumstances (holidays, etc.) it might take a few days longer. If you have any complaints about the delivery of your parcel, you can file a complaint against PostNL via a complaint form on the PostNL website. 7. Returns / Exchanges
If your purchase does not appear to be what you were looking for you can return this product. For this, you have 30 days after receiving your order to indicate that you wish to return an item and then another 30 days to return the product. If the entire order is returned, the shipping costs are also refunded. Shipments are returned on the customer’s account. All size charts are indicative and no rights can be derived from them, the descriptions and specifications of the products are also indicative and usually 100% correct. No rights or obligations can be derived from accidental printing or writing errors of a product description. If the product does not fit, return is also at the expense of the customer. It is important that the product you wish to return is complete and in original packaging. We can not accept damaged or used items in return. Clothing can be tried on off course, but in relation to hygiene, clothing that contains traces of use cannot be returned. Washed clothes therefore cannot be returned. Electronics can only be returned in the sealed package. Opened food and personal care products are not accepted back. If you have bought a bundle offer, the entire bundle must be returned.
Unstamped / COD shipments are not accepted by All Active Trading B.V. .
We have chosen not to make use of the exchange of products. This because it’s for both the customer and for us a long and complicated process. Would you still like to have a different size or for example, a different color of the product? You can return the old product using our returns procedure and then place a new order through our website with the desired product. The outstanding amount of the return will be refunded upon receipt of the return in your bank account.
This is the fastest way to receive the desired product.
Return of Approved Warranty of a Product - We will arrange the return of the product with the supplier, the customer will ensure proper return of the product to our store/address. This means at their own expense, in that case returning in the store is free of course, envelope or postal package is to be paid by the customer himself.
8. Disputes
Dutch law is applicable to all our agreements. The authorized Dutch judge has – in association with other authorities – the jurisdiction to try all disputes that may arise from the agreement between All Active Trading B.V. and the opposing party.
9. Extrajudicial collecting costs
If All Active Trading B.V. has any costs for legal assistance because of nonfulfilment of the agreement by the buyer, the buyer is obliged to reimburse all costs to All Active Trading B.V.. In case of non-payment the extrajudicial collecting costs will be fixed on 25% of the amount due with a minimum of €100,00.
